Court lets Oregon suicide law stand

SAN FRANCISCO — A federal appeals court has refused to reconsider its May decision upholding Oregon's assisted-suicide law.
The Bush administration wanted the 9th U.S. Circuit Court of Appeals to set aside its ruling backing the nation's only law allowing doctors to assist in hastening the death of patients. The court, however, said in a Wednesday ruling made public yesterday that a majority of the San Francisco-based court's 25 full-time judges voted against a rehearing.
A three-judge circuit panel had ruled in May that U.S. Attorney General John Ashcroft cannot sanction or hold Oregon doctors criminally liable for prescribing overdoses under the state's voter-approved Death With Dignity Act.
The panel said states were free to adopt such laws, while the administration claims the federal Controlled Substances Act prohibits doctors from dispensing medication to end a patient's life.
Charles Miller, a Justice Department spokesman, said no decision has been made on a possible appeal to the U.S. Supreme Court.
The assisted-suicide law allows terminally ill patients with less than six months to live to request a lethal dose of drugs after two doctors confirm the diagnosis and determine the patient to be mentally competent to make the request.
Since 1998, at least 171 people have used the law to end their lives, according to state records.
The case is Oregon v. Ashcroft, 02-35587.
Bush and Co. oppose our humanitarian law allowing intelligent and adult human beings to avoid pointless suffering and often tremendous expense and loss of dignity. They hold up the preservation of and admiration for life as being too sacred to allow anyone to choose their own death, even in a hopeless situation.
Yet Bush and Co. favor Capital Punishment, even of mentally retarded people who lack the ability to both realize the seriousness of their actions and to hold a moral understanding about murder. So the murder by the state of someone like that is OK, but someone choosing death for all the right reasons isn't? I guess the value of life is on some sort of sliding scale with them?
And the use of stem cells that come from the 11 approved lines of embryos is OK, but to use the stem cells from frozen embryo banks that are otherwise thrown in the garbage isn't? Nothing like bravely exploring new thoughts and frontiers in human medicine is there?
I think the religious, political and scientific reasoning in use by Bush and Co. is horribly confused and entangled with politics playing as large a role, probably too large a role, in the decisions in these areas as anything else.
