In reality, the true context of this situation is as follows:
The people in that Mosque had been trying their best to kill our guys.
They lost.
One of our guys had been shot in the face, he was the one still on his feet, who entered the mosque and saw one of the enemy still alive, who incidentely, was willing to fight to the death. The guy who was still alive still had the ability to pull a gun and kill, and would if he could. Was the guy faking his disability, or was he still able to inflict death upon us?
Nobody knows because one of our soldiers shot him.
Not a very pretty news spot, but that's what we're doing over there. We are killing people. It's called "war". It's hell. It makes for one heck of an evening hand-wringing contest too, but in the end, our soldiers are trained to kill, and that's why they're over there. Should this guy have shot a man who was wounded and down, "NO". However, put yourself in that situation, where we're there to "kill the bastards", and those bastards are killing indiscriminately with car bombs, cutting off heads and limbs, with tortue chambers, etc., and I dare say you would do the same thing in that context.
Take it out of context and put it on the news, and yes, the UOS and the ACLU will have a field day. In reality, as sad and calloused as it may seem, the guy probably got exactly what he deserved. This time it was done with a rifle instead of a 500-pound bomb dropped from an aircraft.

I don't know technically if these guys were "in custody". My understanding is these were wounded enemy that hadn't been moved. From the sounds of it, the guy who shot thought this guy was faking being dead and maybe paniced, I don't know for sure. What really pisses me off, is more press and international scrutiny will be applied to this single casualty of war then they ever gave Sadam when he was still in power.
